Over the past few years, we have been functioning in a general “reg lite” environment, however, there is evidence that the climate may be changing. For example, in 2019 there was an uptick in the number of fair lending violations referred to the Department of Justice (DOJ). In addition, in 2020, a DOJ proposed consent order suggests, among other things, policy-driven violations remain.
The nature of some issues is particularly surprising and is no doubt influencing the scope of examinations. Join us as we explore:
• Issues that could influence your risk management priorities, and
• Practices to identify and mitigate fair lending risk exposures
Let’s see if our fair lending programs are “On the Money” or if we need to do a little retooling.
March 5, 2021: (9-10:30) Community Reinvestment Act (CRA)
The industry is facing a paradigm shift with a new CRA rule for OCC-regulated banks. Additionally, other banks could face changes as the FRB issued its own advanced notice of proposed rulemaking to solicit comment on its vision of CRA Reform.
Collectively, three development impacting the industry suggest CRA risk management is becoming more challenging:
• Implementation of the OCC’s final rule
• Uncertainty regarding other potential regulatory changes
• Issues arising out of the current environment that could impact CRA performance Is there a playbook to manage through the challenges?

About our presenter:
Bonita Jones is the President of Bonita Jones & Associates LLC, a consulting firm specializing in banking risk management and regulatory affairs. Her prior career, which spanned almost 30 years as a bank regulator, has afforded her expertise in managing risks related to laws and regulations as well as the financial condition of financial service organizations. Her contributions are acknowledged nationally in the private sector as well as a regulator. Ms. Jones has been active in training activities sponsored by the Federal Reserve System, the American Bankers Association (ABA), various state associations as well as private organizations. She has published numerous articles and authors the ABA Bank Compliance Magazine’s “Regulatory Insider” column. Ms. Jones serves on the advisory boards for the ABA Bank Compliance Magazine, the ABA’s Online Professional Compliance Curriculum and is an advisory board member emeritus of the ABA Compliance Schools Board.
